POOL RULES

The Kings Point Recreation Club, Inc. (KPRC) Board of Directors has approved the following Code of Conduct and General Rules applicable to KPRC (also known as Kings Point Pool) facilities and sanctioned activities.


The Kings Point Recreation Club is a private club sustained by annual (and other) passes and donations.


CODE OF CONDUCT
Kings Point Recreation Club or Kings Point Pool (KPRC or KPP) strives to create an atmosphere of respect and courtesy. Appropriate social behavior and treatment of others is expected of all KPRC pool pass holders and guests. Kings Point Recreation Club has long been a hub for neighborhood social activity where individuals and families can relax, enjoy and celebrate Summer in Kings Point/Bel-Aire!


To keep the KPRC atmosphere safe and enjoyable for everyone, abusive behavior will not be accepted or tolerated by anyone participating in any KPRC activities or during the use of KPRC facilities. Boisterous intoxication, audible profanity, reckless behavior or any action that would likely lead to the endangerment of others is strictly forbidden and is cause for immediate disciplinary action.


Any KPRC contracted staff person or Board Member shall be authorized to enforce the Code of Conduct along with any rules and regulations applicable to the facility or sanctioned activity.


Verbal instructions or warnings provided by KPRC staff or Board Members must be followed as they are applicable to the Code of Conduct and General Rules. Any person acting contrary to the aforementioned standards, repeatedly violating any general rules or willfully causing damage to KPRC property may be subject to:

  • A verbal warning

  • An indefinite suspension of the privilege of using KPRC facilities or participating in KPRC sanctioned activities

  • Revocation of passes (annual or other)

  • Legal action

*Annual passes are non-refundable and will not be reimbursed in case of suspension or revocation due to Code of Conduct violations.


KPRC pass holders and guests are encouraged to report problematic behavior to a KPRC Board Member in the event said behavior is not addressed by KPRC staff at the time of the occurrence.


POOL & FACILITY RULES
Anyone using the facilities (pool, clubhouse and grounds) does so at their own risk. No liability will be assumed by the KPRC for the actions of any employee, pass holder or guest in connection with such use.


Rules are outlined below and are followed in order to maintain a safe environment for all pass holders and guests. The pool staff is authorized by the Board of Directors to evict any persons for disorderly conduct on Club grounds. The staff may also, at any time, enforce any additional rules they deem necessary at the time, to ensure the safe operation of the Club.
 

General Rules

  1.  Swimming is permitted during posted pool hours and special events designated by the board. A lifeguard must be on duty. Any swimming outside of official pool hours and events is cause for immediate disciplinary action.

  2. All pass holders and their guests must sign in each time they enter the Club. If a staff member is not available at the time of your arrival, it is your responsibility to sign in or if you have guests to notify a staff member to sign you in and collect any guest fees.

  3. Recreational swimming will be suspended for safety concerns such as weather, poo chemical issues, and swim meets and/or other activities approved by the Board of Directors.

  4. NO pets are permitted on Club grounds at any time. Professional guide dogs are allowed.

  5. Pass holders and guests shall be considerate of others by keeping the volume of radios down and conversation content/volume mindful of children’s presence in the area.

  6. The Club is not responsible or liable for the loss of or damage to any personal property left in the clubhouse or on the Club grounds.

  7. Lost articles not claimed by the day of closing (Labor Day) will be donated to charity.

  8. No smoking is allowed on the pool grounds. This includes “vape” technology.

  9. Recreational drugs are forbidden on the property.


Minors

  1. Children under the age of ten (10) must be accompanied by a parent, guardian or responsible caretaker at all times swimming hours unless prior arrangements are made with the Club Manager. Unaccompanied children under the age of ten (10) will be sent home.

  2. Pass holders shall be required to familiarize themselves, their children, and their guests with the Code of Conduct and General Rules.

  3. Minors who are ten (10) or older are allowed to enter the premises without adult supervision, and may use the pool only if they are able to swim and pass the swim standards. (see Swimming Rules section for more information).

  4. Parents or guardians are accountable for their children and their childrens’ conduct on the Club property.

  5. Children should not be left unattended in the shared clubhouse.

 

Guests

  1. Pass holders are allowed to bring guests to the pool upon paying guest fees or purchasing guest passes. These fees shall apply to pool and facilities use.

  2. Non-pass holders will not be allowed to use the facilities unless accompanied by a pass holder who is 12 years of age or older.

  3. Pass holders are held accountable for their guests behavior as an extension of their annual (or other) pass.

  4. Liability forms must be signed by non-pass holders prior to pool & facility use.
     

Property & Facility

  1. Any person destroying or defacing Club furniture or property will be billed for replacement or repair of that property and may be subject to revocation of pass(es) privileges and/or legal action.

  2. The clubhouse is a shared space. Pass holders shall clean up their trash and area they used, and treat the space with respect. No children shall be left unattended in the clubhouse.

  3. Persons observed climbing perimeter fences of the Club will be subject to immediate disciplinary action. Pass holders are requested to report any violation to the Club staff.

  4. The chairs and lounges are primarily for the use of adults. Because of the limited  number of such furniture, use will be restricted to people age 18 and over, unless chairs are not in use. Children will surrender chairs and lounges upon the request of an adult.

  5. Bicycles shall be parked in the designated area on the east side of the pool by the upper lot and should be locked. Bike racks are provided and should be used by all bike riders. Bikes are NOT to be parked along the fence. The Club is not responsible or liable for any theft.

  6. Skateboards, scooters and inline skates are not allowed to be ridden inside the Club grounds. Skateboards and skates may be carried onto Club grounds and remain with the pass holder for safekeeping. The Club is not responsible or liable for any theft.
     

Food & Beverage

  1. Food and beverages are allowed to be brought by pass holders.

  2. Alcoholic beverages is permitted at KPRC and may be consumed by pass holders and guests of legal age of 21 years or older as set by Colorado state law.

    • IMPORTANT: It is strongly advised that adults use moderation when consuming alcohol at KPRC, and keep in mind that the safety of pass holders and guests is the highest priority. Abuse of alcohol leading to violations of the KPRC Code of Conduct will be handled accordingly. (see Code of Conduct: page 1 for more details)

  3. Glass of any kind is not permitted on Club premises.

  4. Food and beverages are not permitted in the pool or on the pool deck & ledge.

  5. Clean up after yourself. Place all trash, waste paper, pop cans, etc. in the trash and recycle receptacles provided. Leave your area at least as clean as you found it.

  6. No kegs are allowed on the property.

Swimming Pool & Safety Rules: The Club staff and Board Members are authorized to issue

and enforce additional rules deemed necessary for the proper conduct of the pool and for the

protection, health and safety of pass holders and their guests.

 

General Safety

  1. Throwing of rocks or debris is strictly prohibited.

  2. Glass of any kind will not be permitted on Club premises.

  3. The telephone is for emergency purposes only.

 

Swimming Pool

  1. Pool staff will clear the pool at their sole discretion for lightening and/or health & safety concerns.

  2. Any NON-SWIMMER must be accompanied by a responsible ADULT IN THE WATER and within arms-reach at all times, regardless of use of floatation device (includes water wings, noodles, floating swim suits, inner tubes, etc.).

  3. 3. A parent, guardian or responsible caretaker must accompany children under the age of ten (10) during regular swimming hours unless prior arrangements are made with the Club Manager. Unaccompanied children under the age of ten (10) will be sent home if such arrangements have not been made.

  4. Showering is recommended before entering the pool.

  5. There shall be no horseplay or running on the concrete areas surrounding the pool at any time.

  6. Pushing, dunking and rough play is prohibited.

  7. Hanging, sitting or going over lane ropes is prohibited.

  8. Headstands on the edge of the pool or jumping onto flotation devices are prohibited.

  9. Ball playing in the pool will be permitted during slack times at the lifeguard’s discretion. No hard balls will be allowed.

  10. Floatation devices may be allowed in the pool at the lifeguard’s discretion and are restricted to the shallow end of the pool.

  11. No diving or jumping off the starting blocks is allowed.

  12. Do not obstruct the swimmers’ path to the steps or ladders.

  13. The pool will be cleared the last fifteen (15) minutes before each hour for adult swim (those 18 years of age and older).

  14. The lifeguard’s whistle must be observed.

  15. There will be no talking to the lifeguards on duty watching the pool. Visiting with the guards will be kept to a minimum.

  16. Swimsuits are required in the pool. No cutoffs are allowed.

  17. All persons using the pool do so at their own risk. The Club will not be responsible or liable for any accident or injury in connection with such use.

  18. Any incidents of depositing fecal matter in the pool will result in a $250 fine.

 

Deep-end and Diving

  1. Diving is permitted only in the deep end of the pool.

  2. All divers must wait until the area in front of the board is clear before going off the diving board. All entries must be made straight off the end of the board, not diagonally or to the side.

  3. Do not dive off the board until the previous person has safely reached the side of the pool.

  4. Do not obstruct the swimmers’ path to the ladders.

  5. Divers shall swim clear of the diving area immediately upon completion of their dive.

  6. Only one person is allowed on the board or board ladder at any time.

  7. There shall be no side mounting of the board.

  8. No double bouncing on the diving board

  9. There shall be no hanging on the underside of the diving board.

  10. No recreational swimming is allowed in the diving board area, except when the board is not in use.

  11. All swimmers with questionable swimming ability, when entering the deep water or using the diving board must swim one width of the pool to the satisfaction of the lifeguard on duty.

  12. All persons using the diving board do so at their own risk. The Club will not be held liable for any accident or injury in connection with such use.

 

Wading Pool

  1. Six (6) years of age is the maximum age of children allowed in the wading pool.

  2. There is no lifeguard on duty at the wading pool. Parents are absolutely and solely responsible for the oversight, safety and supervision of their children. Any NON-SWIMMER must be accompanied by a responsible ADULT IN THE WATER and within arms-reach at all times, regardless of use of floatation device (includes water wings, noodles, floating swim suits, inner tubes, etc.).

  3. Absolutely no running in and out of the wading pool will be permitted.

  4. Children must wear regular swimming attire or sunsuits while swimming. Plastic pants or swim diapers for infants and toddlers are required.

  5. All persons using the wading pool do so at their own risk. The Club will not be responsible or liable for any accident or injury in connection with such use. Parents are solely responsible for the safety of their children in the wading pool.

WAIVER AND RELEASE OF LIABILITY

The undersigned Pass Holder of the King’s Point Recreation Center, Inc., (KPRC) on behalf of all persons in my household, or guests, having permissible access to the premises (including my children enrolled in summer school programs) pursuant to my pass (hereinafter “Pass holder”), and in consideration of my desire to maintain access to the King’s Point Recreation Club, Inc., and as a condition of my use of the Premises (all grounds, parking lot, buildings, facilities, amenities, bathrooms, changing rooms, swimming pool(s), diving board , and participation in and any all authorized or unauthorized use and activities, and being given the right to participate in same pursuant to promulgated rules; agree:


Pass holder, HEREBY, on behalf of the Pass holder, heirs, executors, administrators, assigns, or personal representatives (hereinafter also collectively, "Releasor," "I" or "me", which terms shall also include Releasor's parents or guardian if Releasor is under 18 years of age), intelligently, knowingly and voluntarily, agree to the terms of this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of my authorized or unauthorized use of the Premises, or participation in any Activity upon the Premises; and Pass holder HEREBY, acknowledges that KING’S POINT RECREATION CLUB, INC., is established for the primary purpose of providing a swimming facility together with other social use, to include social gatherings, and recreation. Use of a swimming pool, in any manner, is an inherently dangerous activity and includes serious risk to the health, safety and welfare of the Pass holder, including risk of temporary or permanent injury, disability, disfigurement, biologic contamination, chemical toxicity, and death. Pass holder acknowledges and agrees that use of the Premises is undertaken at Pass holder's own risk, and assumption of said risk, . Pass holder takes full and complete responsibility to ensure that Pass holder (and those persons authorized to use of the Premises under Pass holder's right of use), is equipped with requisite knowledge, skill, physical and mental capacity, to safely use facilities available upon the Premises for authorized use of the Premises. Pass holder agrees not to participate in the Activity unless physically and/or medically able and properly able to participate in any activity upon, or use of, the Premises.


Notwithstanding the foregoing, Pass holder acknowledges that KPRC may require a test of a person's physical and mental limits prior to permitting use of the Premises, or participation in any authorized activity. Pass holder agrees that no finding of “fitness” to participate in any activity by KPRC shall establish any liability or be evidence of such finding of fitness, for the purpose of invalidating this Waiver and Release.


Pass holder HEREBY releases and forever discharges KINGS POINT RECREATION CLUB, INC, its Board of Directors, Officers, employees, agents, and members, volunteers, heirs, representatives, predecessors, successors and assigns (collectively "Releasees"), from any and all actual damages and losses, physical or psychological/emotional injury, economic or non-economic losses whatsoever, that I may suffer as a direct or proximate result of my participation in the aforementioned Activity or use of the Premises.


I FURTHER AGREE to indemnify, defend and hold harmless the Releasees against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by Pass holder, or anyone on my behalf, including attorney's fees and any related costs.
I FURTHER ACKNOWLEDGE that Releasees are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Releasees.
In the event that I should require medical care or treatment, I authorize Kings Point Recreation Club, Inc to provide all emergency medical care deemed reasonably necessary, including but not limited to, first aid, CPR, the use of AEDs, emergency medical transport, and sharing of medical information with medical personnel. I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.


I HEREBY ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS "WAIVER AND RELEASE"
AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I EXPRESSLY AGREE TO RELEASE AND DISCHARGE Kings Point Recreation Club, Inc., AND ALL OF ITS AFFILIATES,
MANAGERS, MEMBERS, AGENTS, ATTORNEYS, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS, FROM ANY AND ALL
CLAIMS OR CAUSES OF ACTION AND I AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY
RIGHT THAT I OTHERWISE HAVE TO BRING A LEGAL ACTION AGAINST Kings Point
Recreation Club, Inc FOR PERSONAL INJURY OR PROPERTY DAMAGE.


To the extent that statute or case law does not prohibit releases for ordinary negligence, this release is also for such negligence on the part of Kings Point Recreation Club, Inc, its agents, and employees.


I agree that this Release shall be governed for all purposes by Colorado law, without regard to any conflict of law principles. This Release supersedes any and all previous oral or written promises or other agreements.


In the event that any damage to equipment or facilities occurs as a result of my or my family's or my
agent's willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any such actions of neglect or recklessness.


THIS WAIVER AND RELEASE OF LIABILITY SHALL REMAIN IN EFFECT FOR THE DURATION
OF MY PARTICIPATION IN THE ACTIVITY, DURING THIS INITIAL AND ALL SUBSEQUENT
EVENTS OF PARTICIPATION.


THIS AGREEMENT was entered into at arm's-length, without duress or coercion, and is to be interpreted as an agreement between two parties of equal bargaining strength. Both Pass holder
and Kings Point Recreation Club, Inc agree that this agreement is clear and unambiguous as to its terms, and that no other evidence shall be used or admitted to alter or explain the terms of this agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered into.
In the event that any provision contained within this Release of Liability shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect. If a court should find that any provision of this agreement to be invalid or unenforceable, but that by limiting said provision it would become valid and enforceable, then said provision shall be deemed to be written, construed and enforced as so limited.
